Terms of Service

Version in effect on .

In short

  • Pilotiko is an online service for businesses: a virtual office, an assistant and AI agents that prepare the work.
  • Your data stays yours. We use it only to provide the service to you.
  • AI can be wrong: a person in your business checks and approves what matters.
  • 30-day free trial, no credit card. Without a subscription afterwards, the workspace becomes read-only; nothing is deleted.
  • These terms are governed by the laws of Quebec and Canada.

This English version is provided for convenience. In case of discrepancy, the French version prevails.

1. Who is bound

These terms form a contract between [À COMPLÉTER: dénomination légale exacte inscrite au Registraire des entreprises du Québec], NEQ [À COMPLÉTER: numéro d'entreprise du Québec (NEQ, 10 chiffres)], [À COMPLÉTER: numéro, rue et bureau de l'adresse d'affaires], [À COMPLÉTER: ville] (Québec) [À COMPLÉTER: code postal], Canada ("Pilotiko", "we") and the business or person who creates an account or uses the service ("you", the "customer"). A person accepting these terms on behalf of a business represents that they have the authority to bind it. Pilotiko is offered to businesses, for professional use.

2. The service

Pilotiko is an operations web application for small and medium-sized businesses: a virtual office (view of the team and urgent matters), scheduling, clients, tasks, basic accounting, assistant and AI agents and, if you enable them, a phone assistant, email sending and connections to other tools. Some features depend on third-party services (see Subprocessors) and may be changed, improved or withdrawn; we will notify you of a significant withdrawal with reasonable notice.

3. Account and security

4. Acceptable use

You use Pilotiko in compliance with the law and with our Acceptable Use and Anti-Spam Policy, which forms part of these terms. In particular, you send commercial messages only to people who have consented, in accordance with Canada's Anti-Spam Legislation (CASL).

5. Your content and data

6. Intellectual property

Pilotiko, its software, brand, logo and documentation belong to us or are used under licence. You receive a non-exclusive, non-transferable and revocable right to use the service during your subscription. You may not copy, resell, decompile or circumvent the service's technical measures, except as permitted by law. Suggestions you make to us may be used freely to improve the service.

7. Artificial intelligence features

8. Availability and support

We make reasonable efforts to keep the service available and to monitor it, but it is provided without a guarantee of continuous availability: maintenance interruptions, provider outages or incidents may occur. No service-level agreement is offered at this time. Support: [À COMPLÉTER: courriel de soutien, ex. [email protected] — donné à Google comme courriel d'assistance].

9. Trial, prices and billing

10. Term, termination and suspension

11. Warranties and limitation of liability

To the extent permitted by law, the service is provided "as is". We do not warrant that it will be fit for a particular purpose or error-free. Our total liability to you, for any claim related to the service, is limited to the amounts you paid us during the 12 months preceding the event. We are not liable for indirect damages (loss of profits, goodwill or data that you could have backed up). These limits do not apply in case of intentional or gross fault, to bodily or moral injury, or where the law prohibits them. If you are a consumer within the meaning of Quebec's Consumer Protection Act, the rights that Act grants you apply despite any contrary clause.

12. Your commitments towards third parties

You indemnify us against third-party claims arising from content you put into Pilotiko or from messages you send in breach of the law or these terms.

13. Changes

We may change these terms. We notify you of a material change at least 30 days before it takes effect, in the application or by email; if you refuse it, you can cancel your subscription before that date. The version history is at the bottom of this page.

14. Governing law, disputes and language

These terms are governed by the laws of Quebec and the federal laws of Canada applicable therein. Any dispute falls under the courts of Quebec, [À COMPLÉTER: district judiciaire choisi pour les litiges (ex. district de Montréal)], subject to a consumer's right to go to the court of their domicile. Before any legal action, write to us: we will first look for an amicable solution.

These terms are drafted in French, in accordance with the Charter of the French Language. This English version is offered for convenience; in case of discrepancy, the French version prevails. The parties have reviewed the French and English versions; at the customer's express request, the customer may contract in English.

15. General provisions

If a clause is held invalid, the others remain in force. Failure to exercise a right is not a waiver. You may not assign these terms without our consent; we may assign them as part of a reorganisation or sale of the business, with notice. To reach us: [À COMPLÉTER: courriel général public, ex. [email protected]], [À COMPLÉTER: numéro, rue et bureau de l'adresse d'affaires], [À COMPLÉTER: ville] (Québec) [À COMPLÉTER: code postal], Canada.
