CNESST: what should a Quebec small business know before hiring?
From the first hire, the CNESST becomes part of running a service business: registration, hours of work, workplace accidents. Here are the basics, with official sources.
The CNESST (Commission des normes, de l'équité, de la santé et de la sécurité du travail) is the Quebec public body that promotes and enforces workplace rights and obligations. It covers labour standards, pay equity and occupational health and safety, and runs the mandatory insurance plan for workplace accidents and occupational diseases.
In short
- One body for labour standards, pay equity and occupational health and safety.
- Employers must register within 60 days of their first worker's first day.
- The standard work week is 40 hours for most workers; overtime is paid at time and a half.
- A register of accidents, incidents and first aid tracks injuries and near misses.
What does the CNESST actually do?
Spelled out, the acronym stands for Commission des normes, de l'équité, de la santé et de la sécurité du travail. The Quebec government has made it responsible for promoting workplace rights and obligations and for enforcing them with both workers and employers [1]. It also runs a mandatory insurance plan that protects workers and employers when a workplace accident or occupational disease occurs [1].
It is a public body reporting to the minister responsible for Labour, organized into 7 vice-presidencies, with close to 5,000 employees, and it oversees about ten statutes and their regulations [1]. For a small business, that means one point of contact for three topics people often mix up: labour standards (hours, leave, pay), pay equity and accident prevention.
| Area | Typical small-business question | Sample rule |
|---|---|---|
| Labour standards | When is overtime owed? What if a shift is cut short? | 40-hour standard work week [3] |
| Occupational health and safety | What do we do after a cut or a fall? | Record the event in the register [5] |
| Workplace accident insurance | Do I have to register, and by when? | Within 60 days of the first day of work [2] |
| Pay equity | Are female-dominated jobs paid fairly? | Named in the body's full title [1] |

When must a business register with the CNESST?
You must register as soon as you hire at least one worker, full time or part time, and have an establishment in Quebec; the same applies if you engage a self-employed person the CNESST considers a worker [2]. You have 60 days from your first worker's first day on the job, and you can register up to 30 days before they start if you know the date [2]. Registering after the 60 days triggers late fees [2].
Officers and volunteers are not automatically covered by mandatory protection, but optional coverage can be requested when you register [2]. An owner who works on job sites alongside the crew should ask about it.
What does a 45-hour week cost a cleaning company?
Which scheduling rules does the CNESST enforce?
The standard work week is the point at which hours become overtime. It is 40 hours for most workers, so someone who worked 45 hours in a week did 5 hours of overtime [3], and overtime is paid at time and a half [6]. There are exceptions, such as 44 hours for security guards who protect a property on behalf of a security firm [3]. A security agency therefore doesn't count overtime the way a cleaning company does.
Other rules matter directly to businesses that send staff to customers' premises. Travel required by the employer is paid working time, as are the 10 or 15 minutes an employer asks people to arrive early [4]. After 5 consecutive hours of work, an unpaid 30-minute meal break must be granted, and each worker must get at least 32 consecutive hours of rest every week [4]. If you send someone home after an hour because a client cancels, a 3-hour indemnity applies [4].
What is the register of accidents, incidents and first aid for?
The CNESST describes it as a monitoring tool for recording injuries and illnesses at work, assessing the company's health and safety situation and focusing prevention efforts [5]. It recommends recording every accident, incident or illness as soon as possible, even without serious consequences [5]. An incident is an event with no injury that could have been serious, such as an object falling near a worker or a slip with no harm done [5].
The first aider who treats the worker fills in the register: the worker's name, the time and exact location of the event, a description of what happened, the nature of the injury and the first aid given [5]. For a cleaning crew handling chemicals and ladders, the register is often the first sign that a work method needs fixing.
Which CNESST mistakes should you avoid?
- Waiting for the first payroll run to register and missing the 60-day deadline.
- Assuming officers are covered automatically; optional protection has to be requested.
- Not paying travel time between clients when the employer requires the travel.
- Stacking shifts so a worker never gets 32 consecutive hours of rest in the week.
- Recording only serious accidents and skipping incidents with no injury.
- Applying the 40-hour threshold to guards at a security firm, whose standard week is 44 hours.
Does Pilotiko file anything with the CNESST?
No. Pilotiko doesn't run payroll, register employers, file with the CNESST or keep the accident register. What it does provide is scheduling of appointments and suggested assignments based on each person's calendar and workload, which keeps schedules visible to the manager. Complying with the hours rules remains your responsibility. To estimate what an employee costs in Quebec, see our study and the calculator, plus our entry on workforce planning.
Frequently asked questions
What does CNESST stand for?
Commission des normes, de l'équité, de la santé et de la sécurité du travail. It brings labour standards, pay equity and occupational health and safety under one roof.
How long do I have to register with the CNESST?
Sixty days from your first worker's first day of work. You can also register up to 30 days before they start if you know the date. Late registration comes with late fees.
Does a self-employed person have to register with the CNESST?
If they hire nobody, the employer registration rule doesn't apply to them. A business that engages a self-employed person whom the CNESST considers a worker must register, though. Optional coverage also exists for some people who aren't covered automatically.
Is travel time between clients paid?
According to the CNESST, travel required by the employer counts as working time and must be paid. That matters for home-service companies whose staff visit several addresses a day.
Should an incident with no injury go in the register?
The CNESST recommends recording incidents too, meaning events with no injury that could have had serious consequences. The more incidents there are, the more likely an accident becomes, so tracking them helps prevention.
What is the 3-hour indemnity?
It is a payment equal to 3 hours' wages owed to a worker who reports for their usual shift and has it cut short by the employer. It must include estimated tips, and it doesn't apply in cases of force majeure.
